CLARIFICATION OF GREG DIAZ'S CLERK-RECORDER EXPERIENCE

To fully understand this candidate's qualifications one must know the different departmental structure between Nevada and San Francisco counties.  In our county the Clerk-Recorder is elected and is responsible for both elections and recording duties.  The title for the elected officeholder in San Francisco is "Assessor-Recorder", and that position has no authority over elections.  A separately appointed commission manages elections.  Mr. Diaz was never elected "Assessor-Recorder" in San Francisco, nor did he ever hold a position in the elections commission to the best of our knowledge.  Also, he was not the person who was totally responsible for the activities of either department.  To campaign on the premise that he has "twenty years of professional clerk-recorder experience" is misleading to our electorate!  Unless fully informed, voters will assume he held a post that was elected, and that he was completely responsible for both the recording functions and for managing elections.  To be clear, the Director of Elections heads the independent SF Department of Election who is appointed by the Election's commission through an application process.  The Election's commission is made up of appointees by various elected officials.

The following excerpts and quotes  will help voters  understand what Gregory Diaz has actually done.

The first excerpt offers some insight regarding the quality of the office in which Mr. Diaz worked.  It is from the San Francisco Bay Guardian News endorsement list for the 2005 elections, regarding the Assessor-Recorder's office.  We quote; "This is one of the most important offices in the city, and for decades it's been filled with corrupt or incompetent politicians who have lost such staggering sums of money for the city that it's painful to even think about.  The last two elected assessors haven't fared well: Doris Ward left under a cloud, with the federal bureau of investigation swarming all over her office.  Mabel Teng unexpectedly resigned without ever giving a credible explanation, and hasn't been seen much around town since."  A quote from Bay City News, May 10, 2002: "Her Chief Assistant Gregory Diaz said he had not seen or talked to her and did not know Ward's whereabouts."  This statement was made to FBI agents who were raiding their office and  had just shut down the operation.  Was Diaz Chief Assistant, or Chief Enabler?  How can you be that close to the top, and not know good from bad behavior and ethics.  Ward served two terms.  In the case of Chase Manhattan Bank (plaintiff) vs. City and County of San Francisco (defendant), argued October 7, 1996, and decided August 18, 1997, defendants include; "Bruce Jamison, County Recorder, Greg Diaz, Acting County Recorder for the City and County of San Francisco."  Between the FBI raid in May 2002 and January 2003 Diaz left the San Francisco office and was employed by the Placer County Clerk-Recorder.  He worked there from January 25, 2003 until October 3 of that year.  His position was Clerk Recorder Manager, and he had no involvement with elections.

Several questions and answers exchanged with the San Francisco elections commission follow:

First question: "From what I can determine, currently the Assessor-Recorder is completely separate from the department of elections and does not participate in overseeing elections?"

Answer: "You are correct."Question: "Can you please tell me if that was the case in the time frame of 1995 to date?"

Answer: "Yes."

Another response:  "You are correct.  The Assessor-Recorder's office is separate from the Department of Elections. I understand that the Departments were separate offices 8 years  prior to that date (1995)."

Nevada County  needs competent elections oversight.  Diaz's record does not support his website claim of overseeing twelve elections.  His claim of "five trouble free elections' in Nevada County is not accurate either, and that representation will be addressed in another article.  The people of this county deserve to know the veracity of a candidate's assertions before selecting that person to handle a function as sensitive as elections.  The county does not need a slick bureaucrat who is morphing into a slick politician.

Five Propositions on June Ballot

Very important dates for California voters:
May 8 - Absentee ballots can be sent to mail-ballot precincts and absentee voters
May 24 – Last day you can register before the June Primary
June 1 – Last day to apply for absentee ballot by mail
June 8 – Primary Election Day

There are 5 propositions on the June ballot, with 2 already qualified for the November General Election. A total of 80 initiatives have been cleared by the Secretary of State for circulation.

Statewide initiatives require 433,971 valid signatures of registered voters on properly executed petitions. They must follow a rigorous process that takes many months with up to 5 months of signature gathering.

There are many questionable actions related to the naming of ballot initiatives.  Assemblyman Dan Logue has worked very hard to get a proper name on the California Jobs Initiative to suspend California’s version of the Federal Cap and Trade/Tax that is working toward the November 2010 ballot. The Attorney General’s title is “Suspends Air Pollution Control Laws Requiring Major Polluters to Report and Reduce Greenhouse Gas Emissions That Cause Global Warming Until Unemployment Drops Below Specified Level for Full Year.”

Here is a brief summary of the propositions and recommendations for the June 8 ballot:

Proposition 13:  “Property tax relief for seismic retrofits” – this constitutional change will protect home and business owners from new property taxes if they decide to seismically retrofit their property. A YES vote is recommended.


Proposition 14:  Primary election Process Reform. Greater Participation in Elections.
The title of this proposition obfuscates its purpose.  There will not be greater participation while it promotes less representation. This proposition is on the ballot because of a backdoor budget vote trade, and Democrats and Republicans actually agree, this is not a good idea. This would create a “top two” primary election and prohibits Central Committee and party nomination for candidates.  A NO vote is recommended.

Proposition 15:  California Fair Elections Act. This is another proposition with a cleverly disguised title.  It repeals the ban on public funding of political campaigns and creates a system to fund the 2014 and 2018 Secretary of State campaigns. A lobby fee of $700 will generate about $6 million every 4 years. As a way in the back door to publicly funded campaigns, the Legislature could vote to extend this act to all statewide offices at any time. A NO vote is recommended.

Proposition 16: “Requires 2/3 voter approval for local public electricity providers” Local government would have to receive 2/3-voter approval before they use public money or issue bonds to go into the electricity business. A YES vote is recommended.

Proposition 17:   “Drivers transfer of insurance discounts” This proposition allows good drivers with continuous coverage to keep their discounted insurance rate if they choose to switch insurance companies. This could save up to $250 by eliminating the surcharge car owners face when they change to another insurance company. A YES vote is recommended.

Environmental Protection Agency "Gone Wild"

On average, federal agencies and departments issue nearly 8,000 regulations per year to implement statutes written by Congress.  To help the American public understand how important it is to follow the growing volume of government regulations the Environmental Protection Agency (EPA) is sponsoring a "Rulemaking Matters!" Video Contest with the grand prize being $2,500. To win one must submit by May 17 a video that best explains why federal regulations are good and how ordinary citizens can become more involved in making regulations. The videos must be posted on YouTube and can be no more than 60-90 seconds in length.  The contest rules require that each video include the slogan “Let your voice be heard,” and it must direct viewers to the government’s regulatory website www.Regulations.gov. The winning video will then be used by the entire federal government to promote the regulatory process and enhance the public’s participation in it.  And, the EPA is managing the contest on behalf of the entire United States government.  The winning video will be announced by EPA in June 2010.

The following points appeared in press releases issued by the EPA:

"Almost every aspect of an individual’s life is touched by federal regulations, but many do not understand how rules are made or how they can get involved in the process.”


“Federal agencies write laws called regulations or rules,” the contest’s information guidelines states. “When Congress writes a statute and the President signs it, it usually doesn’t have enough detail for it to be put into effect. So, federal agencies fill in the details by issuing regulations.”
 
"The videos must also remind viewers that regulations are the law and that they actually outnumber laws passed by Congress on the order of 10-1."
 
“Regulations have the power of law. Breaking them can result in fines and even jail time. Regulations outnumber Congressional statutes. For every statute passed by Congress and signed into law by the President, federal agencies create about 10 regulations, each of which have the force of law.”
 
"Regulations have a direct impact on your life and the life of every American citizen.”

“The price of the coffee you drink in the morning is affected by regulations written by the Commodity Futures Trading Commission. The television shows you watch are regulated by the Federal Communications Commission. The quality of the air you breathe is affected by regulations written by the Environmental Protection Agency.”

“The overall message should promote greater awareness of Federal rulemaking, motivate others to participate, and perhaps, even change the common perception of Federal rulemaking.”

Editor's Note:  Does any other freedom loving citizen of the United States of America see something wrong with the EPA spending our Federal Tax Dollars on a contest to create propaganda videos?  And, furthermore, that the EPA is managing the contest on behalf of the entire United States government?

Off the Top of My Head

“Those who forget history are doomed to repeat it” is an often heard phrase.  However, this statement implies that repeating history might be bad, whereas repeating the history of applied technology business development in Nevada County might be good for our struggling economy.

Recreating the glory days of innovation in Nevada County is the goal of many local political and economic leaders who promote “going green” to save the economy.  They want to repeat the history of innovative business development in Nevada County in the 50s and 60s, by investing in green technology.  

The question is, how viable is this strategy?

With the gold mines closing and the lumber industry in decline in the 1950s, the local economy was struggling, with many store fronts covered in fly spotted paper. The economic horizon was rather bleak, when Charles Litton Sr decided to move his Litton Engineering Laboratories from the Bay Area to Grass Valley.

Litton’s wife “Lu” suffered from allergies, which were not evident when she visited their summer home on Jackson Lake. Litton wanted to move out of the Bay Area into the foothills. He found the unfinished Memorial Hospital, on what we now know as Litton Hill, and bought the property which was falling into disrepair.  

Much of the economic development in the late 1950s and 1960s in Western Nevada County can be traced to Litton’s arrival. He was a talented and creative engineer and had high hopes for the region. He invited like minded people to come to Nevada County to enjoy the beauty of the region, including Dr. Donald Hare, who started Grass Valley Group.

In Litton’s offer to buy the hospital, he expressed a desire to diversify the local mining and lumber economy. He thought Litton Engineering Laboratories would benefit the community and provide opportunities for young people to seek technical careers. In his August 1953 offer for the Memorial Hospital Litton wrote:

“It has long been my opinion that communities such as Grass Valley and Nevada City could greatly benefit from more diversification of industrial endeavor. Most such communities cannot provide opportunity for their younger citizens who might like to engage in the trades or professionally in scientific and electrical fields, and providing such an industry at this time - if successful - might well lead to other complimentary light industries following suit, thus providing more opportunities than we alone could hope for.“

Over the next 20 years, Charles Litton’s vision for economic diversity was realized. His facility on Litton Hill became the incubator for a world renowned cluster of applied technology business, with Grass Valley Group being the most widely recognized.  Others were skunk works that did not want any public recognition, but produced leading edge technology based products, including video recorders, the Atari 2600 which is the mother to many cartridge based game players, and the first high speed modem chips.  


Missing in the current strategy is a green version of the Litton Engineering Laboratory that can serve as an incubator for the development of green technology.  For the strategy to succeed, the County needs a green technology leader with the vision, the technical savvy, and the drive to succeed, that Litton brought to the community.  

All the green technology initiatives that I am aware of in Nevada County are seeking government stimulus grants to get their green businesses off the ground.  While government contracts were important in getting Litton’s microwave tube business started during WWII, he was more interested in moving beyond dealing with the Government. His glass blowing technology would be a vital to the manufacturing of fiber optic cables and he played a crucial, but relatively unknown, role in the development of silicon computer chips.

Back to the basic question. Where are the green technology visionary and business leaders in Nevada County?  Where is the cutting edge green technology development that can create the must have green products of tomorrow?

I do not see any innovators only followers trying to do what others are doing. That does not mean they do not exist. Innovators often hide from potential competitors, waiting until they have proven technology to take to the market. This was true in the 1960s and 1970s, especially for the developers of video recorders, video games and integrated circuit chips.

Nevada County cannot recreate past economic development success by creating bio-fuel processing in plants, sustainable truck gardens, worm farms and energy saving retrofits. In the short term these activities can all create “green jobs,” but they are not the highly skilled jobs that lead to more innovations.

One bright spot on the horizon is Nevada City’s effort to secure Google’s ultrahigh speed Internet demonstration project. If Nevada City succeeds in securing this advance technology, innovators will flock to the community to take advantage of the technology and share in our foothill lifestyle. These broadband visionaries could create our next robust business sector.

However, if Google looks elsewhere, where will we find the green visionaries? Where will we find a green version of Charles Litton to provide an incubator for Nevada County’s next technology cluster?  Lacking a visionary leader and a green technology incubator, the probability of repeating our past economic glory is slim to none.

The current volcanic eruption going on in Iceland, since it first started spewing volcanic ash a week ago, has, to this point, NEGATED EVERY SINGLE EFFORT you have made in the past five years to control CO2 emissions on our planet.  Not only that, this single act of God has added emissions to the earth estimated to be 42 times more than can be corrected by the extreme human regulations proposed for annual reductions.

The volcanic ash emitted into the Earth's atmosphere in the past week has totally erased every single effort you have made to reduce the evil beast, carbon.  And, those hundreds of thousands of American jobs you helped move to  Asia with expensive emissions demands on businesses... you know, the ones that are creating even more emissions than when they were creating American jobs, well that must seem really worthwhile now.

As California goes, so goes the nation

The title of this offering is a catch phrase that is often heard here in the Golden State. How true it is, I don’t know, but if it is at all true I want to apologize to the rest of the country for what we are about to export to the nation. A warning, if you will, to take a good look at current California politics, policies and business climate. If we are any indicator as to what is coming your way, please take heed.

California has been under a progressive and liberal controlled legislature for 40 years starting with Governor Jerry Brown (governor moonbeam to the locals) in 1970. Prior to that we had one of the best educational systems in the country, one of the best highway systems in the country and our unemployment rate was generally below the national average. We had water, fuel, housing and our Central Valley agriculture produced more of just about any commodity than any other state in the country. We were the 5th largest economy in the world.

Currently, our school system spends more money per student than any other state and produces a student that ranks 49 out of 50. Our highway system is in such a state of disrepair that it is said that a blind person can tell when crossing the border into any of our neighboring states by the change in the smoothness of the highway. Our current unemployment rate is 12.8% and shows no indication of going down. 650,000 manufacturers have left the state and our population has a net decline of a million or more. Our agricultural industry is short on water, our oil industry is all but shut down, real estate prices are in the tank, we are 8th or 9th in world economies, our bond rating is non-existent and we have a projected $20 billion rolling deficit for the next five years.

The causes are many and include a litigious society, public sector unions, teacher’s unions, fraudulent environmental science, entitlements, unfriendly business climate, legislators who believe that businesses are the deep pockets of government, government regulations and uncontrolled bureaucracies and policies. It is the last of these I wish to focus on here.

In 2006, the legislature passed two bills, one in the Senate (SB375) and one in the Assembly (AB 32). The former covers Land Use and Planning and the latter Business and Transportation. Both are unfounded mandates to local government by the state. In SB375 we learn that our future is one of walkable and sustainable communities with emphasis on public transportation and restricted areas of development through conservation easements and other planning restrictions. All of these are directed to compressing the rural population into the urban areas so that living in the country will be a thing of the past. SB375 will determine the type of living quarters you have and where it is located so that you no longer need a vehicle, thus controlling your movement about. AB32 sets up the California Air Resources Board as judge, jury and executioner with regards to business. CARB is the lead agency of AB32 and writes the regulations, requires reporting from businesses on their carbon production, verifies their reporting, enforces the regulations and sets and collects the fines. Another facet of AB32 is the control of diesel equipment used to transport people and goods, including agricultural products. Required is the upgrading of diesel engines to the tune of between $20,000 and $80,000 each. All of this is obviously passed on to the end user, the consumer. 

Though these Bills were passed in 2006, their main effects to not take place until 2011 and 2012. Currently there is a ground swell of public outrage against them as the folks get wind of how this legislation will affect their lives and freedom. Organizations such as The California Association of Business, Property and Resource Owners (CABPRO) that I currently work for are as active as their budget permits in rolling back this onerous usurpation of public rights.  We can only hope that we are successful.

DMV fees soaring and No 30 year exemption!

Let me start off by saying that I’m a young republican and have always supported small government and more freedoms for the people. I never really wanted to get involved in politics like so many young people of my generation. I have always been of the mindset that my parents would take care of things for me as far as politics go.

Some years ago it started to upset me that more of my money that I made was going to the government and not in my pocket so I could spend it on myself and boost the economy. It still didn’t hit me. Then I started a family and it really sank in… my parents generation is slowing dying. There are more of us and less of them. So I started to ask myself what are some things that really effect everyday life that we have to have to work and operate in America? DMV… it seems to be the underground life blood of our society you can’t work without a Drivers license and you can’t drive your car unless it passes smog and you pay your fees.

So my plight started in 2005 when Arnold sat idle by and let our DMV fee’s sore up 80% and us Californian’s were so upset he heard our cry and promised a solution that would make everyone happy. Well he did keep most of that promise. He signed a bill that reversed the 80% fee hike… with his right hand and with his left hand signed a bill that would REMOVE the 30 year smog exempt rule. And he froze the 30 year car rule at 1975 so we are stuck with lower DMV fees and no 30 year smog exempt rule. Or are we?

NO! Arnold took advantage of us again and set in motion me getting involved and making my voice heard! Arnold told us that we would need to pay 80% fee hike at DMV to help the state balance the budget. Has it worked? Well in my opinion NO it has not. We still don’t have the 30 year smog exempt rule we were promised. We as Californian’s need to speak up and more importantly we as American’s need to stand up and take back this country from the Big brother Government that is stealing money from the next generation to fund their out of control spending.

CABPRO Interview of Congressman Tom McClintock (April 5, 2010)

On April 5th Congressman Tom McClintock, representing the 4th District of California, took time out of a very busy schedule to be interviewed at CABPRO's office in Grass Valley, California, by Dick Marshall.  Given space limitations we are providing the following brief excerpts of Congressman McClintock's remarks:

About the recent government takeover of healthcare:

"Under the provisions of this bill, Americans will be required by federal law to purchase health insurance policies.... and will face federal fines and even imprisonment if they refuse.  And they will pay for them through a combination of higher taxes, higher premiums or lower wages."

“What's really dangerous about this bill is that Congress has the power to order Americans to purchase insurance – or any other product – is contrary to the fundamental concept of individual liberty and antithetical to the takings clause of the Fifth Amendment.  If this precedent were to be upheld, the federal government will have assumed authority over every aspect of individual choice in the care of ourselves and our families and can logically be extended to what foods we choose or to what physical activities we engage in. Once the precedent is established that government may usurp individual decisions in the marketplace, what limitation remains on its power to order any other of our decisions as consumers?  In the next recession it could be possible for the Federal Government to order what kind of car Americans are to buy, where to buy it and when."

“Luckily, we still we still have the Bill of Rights which protects our freedom from such usurpations.  It will fall to the Supreme Court to hold this act accountable to the Constitution and it will fall to “We the People” to hold those responsible for it accountable at the polls.”

About today's current political climate:

"People are reawakening because they are beginning to realize that their lifestyles could change, they could lose their property and that their very existence is being threatened."

"It is troubling to see 40 years of bad policies that are destroying California are now being implemented at the Federal level to destroy America.  California should be the morality playground for most of the country to watch as these policies are implemented."

"There is a clash today between those having different views of government....those that want the all knowing government to take care of them and those that want less government involved in their lives."

"We the People have let government get out of control."


"We must engage our fellow citizens as they begin to awaken realizing they made a mistake and we must encourage them to vote in the next election."

False Philosopher-Kings and the Uncommon Sense

In Plato’s The Republic, he proposed an ideal society that would be ruled over by philosopher-kings, rulers who had a genuine love of knowledge and wisdom. These men would be truly well-learned and understanding so as to best lead their society. This is the ideal but the reality falls vastly short of it. The rulers of today’s society, most especially our latest President, retain the aspect of a truly knowledgeable ruler but that aspect is hollow and ill fitting.  The government acts as if they are our betters, telling us what to do and how to do it, as if we are children.  If this was just the beginning of this trend then something might be done about it but it has gone on far too long for many to take heed.  They say that if you put a frog in boiling water, the frog will jump right out.  However, if you put the frog in the water and steadily increase the temperature until boiling, the frog would not notice until it is too late.  After incrementally being told more and more how their lives should run, eventually the populace defers to Government and the media for instruction instead of taking it upon themselves to make the choices.  If one takes a look at television, one will see show after show on how a person should or should not do things.  Classically is the example my father always told me in jest, “Don’t put your hand in the fire and don’t poke yourself in the eye with a sharp stick”.  Now maybe if we were mere younglings this information might come as a revelation but it has frighteningly become more uncommon to have common sense.  There are disclaimers on To-Go coffee mugs “Caution: Hot” because of that lawsuit some years ago, when that person spilled the hot coffee on themselves.  Apparently, we need to know that when we order hot coffee…that the coffee is hot and we should not spill it upon ourselves.  Of all the lawsuits plaguing California, how many are based in the simple lack of common sense in the people and of the judicial system catering to them?  The person who sued because of the coffee burn is a prime example.  The lawsuit went through and so now people do not have to think about if the coffee is hot, the cup tells them.  What is worse is that some politicians make it their personal mission to save the “helpless” populace from their own selves.  After all, these people in power are so much wiser then we so they need to pass laws to help us since we just cannot make our own choices, right?  The seatbelt law is an example of some action that affects no one but the occupant; however, it is a law that the politicians have passed to “help” the populace.  I, by no means, want to imply that one should not wear a seatbelt but I would like to point out how odd it is that it would even be a law.  For now it is required for all, despite what an individual believes.  If I do not wear a seatbelt and I get into a car accident, no matter what happens to me the fact that I chose to not wear one does not affect the rights of anyone else.  So why make it a law at all?  A suggestion would suffice, a Public Service Announcement to inform of the dangers and leave it to the populace to decide what they want to do.  It seems we do not get to make our own decisions anymore.  The False Philosopher-Kings get to tell us what to do now, from their lofty position as…what?  These are not preternatural beings; they are just people like the rest of society.  They should in no way take away the ability for the people to think and make their own decisions.  They should leave us be when we spill coffee on ourselves and get burned.  When we can sue out of our responsibility claiming ignorance of something that should be common sense, allowing the obligation fall on another’s shoulders for not telling us, out goes the idea of personal responsibility.

The AYES and NOES of AB32 (Global Warming Solutions Act of 2006)

April 3, 2006, AB32 was introduced, authored by former Assembly Speaker Fabian Nunez and former Assemblymember Fran Pavley.

August 30, 2006, the California State Senate passed AB32 by a vote of 23 to 14, with 3 Senators absent, abstaining, or not voting.
August 31, 2006, the California State Assembly passed AB32 by a vote of 47 to 32,  one vacancy (AD-67).


September 27, 2006, AB32 was signed into law by Governor Arnold Schwarzenegger.

AB32 (Global Warming Solutions Act of 2006) establishes a timetable to bring California into near compliance with the provisions of the Kyoto Protocol. AB32 requires that by 2020 the state’s greenhouse gas emissions be reduced to 1990 levels, about 25% reduction under business as usual. CARB (California Air Resources Board) is in charge of planning and implementing the regulations necessary to achieve AB32’s goals. Four plus years into the implementation of AB32 it is clear that it is and will continue to be a disastrous decision for the California economy (see various articles in the April, 2010 CABPRO News). It must be suspended or repealed. We provide the following list of California legislators who voted for and against this horrific law in 2006, and where they are now.

Time to get rid of the supporters of AB32 and support those who wisely voted against it.
